1. SPONSOR: The Sponsor of the Contest is «Ƶ Laboratories, 100 «Ƶ Park Road, «Ƶ Park, IL 60064 (“Sponsor”), and the Official Administrator will be The Specialized Marketing Group Inc. (TSMGI), 775 Waukegan Rd. Suite 201, Deerfield, IL 60015 ( “Administrato”).
2. CONTEST PERIOD: The Contest begins at 12:00:01 a.m. U.S. Eastern Time (“ET”) on April 19, 2025 and ends at 11:59:59 p.m. ET on December 31, 2025 (“Contest Period”). Additionally, consideration for individual races will be subject to an additional deadline for each race, as set forth in Section 6 below.
3. PARTICIPANT ELIGIBILITY: In addition to the eligibility requirements provided elsewhere in these Official Rules, including Section 4 below, this Contest is open only to individuals referred to as “Participants” (i)legally residing in the fifty (50) United States or the District of Columbia, (ii) who are at least eighteen (18) years of age (19 in AL/NE), as of the date of submission of their Entry (defined below), and (iii) who have or can obtain legally required travel documents which would allow them to travel to the location of an Award. The following are not eligible to enter or receive an Award: (a) physicians, including a Doctor of Medicine, Doctor of Osteopathy, Doctor of Dentistry, Doctor of Dental Surgery, Doctor of Podiatry, Doctor of Optometry, or Doctor of Chiropractic Medicine; (b) licensed non-physician health care professionals, including a registered nurse, pharmacist, nutritionist, social worker, physical therapist, and physician's assistant; (c) non-licensed non-physicians who work in health care, including phlebotomists, technicians, and laboratory employees; (d) employees, contractors, agents, directors and officers of Sponsor, and each of its affiliates, subsidiaries, and advertising and all other service agencies, including Administrator, that are involved with the Contest; and (e) the family members (spouse, ex-spouse, de facto spouse, child or step-child [whether nature or by adoption], parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1st cousin and household member) of any individuals in (d).
4. TO ENTER: All Contest Entries must be submitted and received before the end of the Contest Period to be eligible. Participant may not enter with multiple e-mail account nor may Participant use any other device or artifice to register multiple times or as multiple Participant. Any Participant who attempts to enter under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all awards won, in Sponsor’s discretion.
i. To enter the Contest, Participants must complete the Contest registration form linked at and agree to the «Ƶ Laboratories Privacy Policy (found at /privacy-policy), and these Official Rules. The registration form will require Participants to: (a) provide their contact information, including phone number, mailing address, and a valid e-mail address; (b) provide preferences of races that Participant desires to run from those listed; (c) explain how running has helped them pursue and achieve their best health (“Health Story”); (d) confirm that they are willing to share their Health Story publicly (for example, in Sponsor marketing materials, social media, video and media interviews); and (e) agree to these Official Rules.
ii. By following the instructions above, Participant will receive one (1) entry into the Contest (“Entry”) for an opportunity to receive up to two (2) Awards to the races selected by Participant on the Contest registration form, limit one (1) Entry per person. Participants will be notified if they are selected as a potential Award recipient, on a per race basis, at least 3 months prior to any marathon race and 1 month prior to any other non-marathon races.
iii. By submitting an Entry, Participant warrants and represents that submitted content: (a) is Participant’s original work; (b) has not been previously published; (c) has not won previous awards; and (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. You agree to indemnify and hold harmless Sponsor from any claims to the contrary. Sponsor’s decisions are final in all matter relating to this Contest.
iv. Participant understands and agrees that Sponsor has wide access to ideas, stories, and other literary, artistic, and creative materials submitted to it from outside sources or developed by its own employees and agents (together, “Sponsor Creative”); and, such Sponsor Creative may be competitive with, similar to, or even identical to the Entry submitted by Participant; and Participant acknowledges and agrees that Sponsor shall have no liability to Participant or any third party in respect to or in connection with the development, use, sale and/or commercial exploitation of all or any portion of Sponsor Creative by Sponsor and/or its designees and licensees, all of which liability, if any, Participant hereby expressly and irrevocable waives, releases, and discharges.
v. Participants who do not follow all of the instructions, or abide by these Official Rules or other instructions of Sponsor may be disqualified along with their associated Entry. Carefully read these Official Rules. By submitting an Entry, you By submitting an Entry in the Contest, you hereby warrant and represent that your Entry conforms to the entry requirements set forth herein and indicate your agreement to be bound by these Official Rules.
5. SELECTED WINNERS AND NOTIFICATION: Sponsor will select winning entries, in its sole and absolute discretion, from among all eligible Entries received during the Contest Period based on equally weighted judging criteria of (i) uniqueness, (ii) creativity, (iii) connection to health, and (iv) impact on others/community. In the event of a tie, a tie breaker will be based upon the highest score in the first judging criteria, then moving to the subsequent judging criteria, as needed to break the tie. A PARTICIPANT IS NOT A RECIPIENT OF ANY AWARD, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY AND COMPLIANCE WITH THE OFFICIAL RULES HAVE BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. Potential wining Participants will be notified by e-mail at least three (3) months prior to Marathon races or at least one (1) month prior to all non-marathon races. Failure to respond to the Sponsor’s request within three (3) business days after notification will result in Participant forfeiting any potential Award. Each potential winner is subject to verification, including verification of age and background. If a Participant is found not to be eligible or not in compliance with these Official Rules, or if acceptance notification is returned as undeliverable, the Participant will be disqualified. In the event that a Participant is disqualified for any reason, Sponsor reserves the right to give an Award to an alternate Participant who will be selected via the remaining eligible entries winner who will be selected via the judging criteria from the remaining eligible entries, even if the disqualified potential winning participant’s name may have been publicly announced. Participants may be required to sign and return within three (3) business days an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release where allowed by law (“Participant Documents”) as well as an IRS Form 1099 (if required). If the Participant Documents are not returned to Sponsor within the specified time period, or if Participant cannot be contacted for any reason, such Participant will be disqualified and an alternate Participant will be selected from all remaining eligible Entries received during the Contest Period.
If, for any reason, this Contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then the Sponsor reserves the right at its sole discretion to cancel this Contest and determine the winning Participants from among all eligible Entries received prior to cancellation, as set forth above.
6. AWARD DETAILS AND RELATED TERMS: Prizes will include entries for the following races and awarded based on eligibility, submission and races selected by Participant in the registration form (each an “Award”). AWARDS DO NOT INLCLUDE AY ADDITIONAL EXPENSES OR FEES, INCLUDING BUT NOT LIMTIED TO TRAVEL, ACCOMODATION, OR MEAL EXPENSES. EACH AWARD RECIPIENT IS RESPONSIBLE FOR THEIR OWN EXPENSES.
a. 2025 BANK OF AMERICA CHICAGO 13.1 (June 1, 2025) = maximum of 10 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by April 27, 2025. Approximate value of bib is $115 USD.
b. 2025 TCS SYDNEY MARATHON (August 31, 2025) = maximum of 8 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by May 12, 2025. Approximate value of bib is $135 USD.
c. 2025 BMW BERLIN-MARATHON (September 21, 2025) = maximum of 25 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by June 1, 2025. Approximate value of bib is $225 USD.
d. 2025 ABBOTT CHICAGO 5K (October 11, 2025) = maximum of 50 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by August 11, 2025. Approximate value of bib is $46 USD.
e. 2025 BANK OF AMERICA CHICAGO MARATHON (October 12, 2025) = maximum of 30 race entries to be awarded. To be considered for this race, Contest Entries must be received by June 22, 2025. Approximate value of bib is $250 USD.
f. 2025 ABBOTT DASH TO THE FINISH LINE 5K (November 1, 2025) = maximum of 30 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by September 1, 2025. Approximate value of bib is $40 USD.
g. 2025 TCS NEW YORK CITY MARATHON (November 2, 2025) = maximum of 24 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by July 13, 2025. Approximate value of bib is $315 USD.
h. 2026 TOKYO MARATHON (March 1, 2026) = maximum of 10 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by November 1, 2025. Approximate value of bib is $160 USD.
i. 2026 BANK OF AMERICA SHAMROCK SHUFFLE 8K (March 22, 2026) = maximum of 10 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by December 31, 2025. Approximate value of bib is $50 USD.
j. 2026 BOSTON 5K PRESENTED BY HARVARD PILGRIM HEALTH CARE (April 18, 2026) = maximum of 8 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by December 31, 2025. Approximate value of bib is $60 USD.
k. 2026 BOSTON MARATHON PRESENTED BY BANK OF AMERICA (April 20, 2026) = maximum of 20 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by December 31, 2025. Approximate value of bib is $375 USD.
l. 2026 TCS LONDON MARATHON (April 26, 2026) = maximum of 24 race entries (bibs) to be awarded. To be considered for this race, Contest Entries must be received by December 31, 2025. Approximate value of bib is $90 USD.
Participants who have already successfully registered for an entry into the race for which they have applied for in this Contest will be deemed ineligible to win an Award for that race.
HOW TO CLAIM AN AWARD: Award recipients must register for the race through the respective official race registration website within 10 business days of notification as a verified contest recipient, and agree to the Terms & Conditions of the respective race. Sponsor shall provide registration instructions and deadlines to Award recipients once they have been notified and verified according to Section 4 of these Official Rules.
LIMIT: one (1) Award per Person. Award is non-transferrable, and no cash equivalent or substitution of Award is offered, except at the sole discretion of Sponsor. Travel, meals, gratuities, luggage fees, hotel charges and any other travel-related expenses are the sole responsibility of Participant and are not part of the Award. Award will be forfeited if participant is unable to participate in the race on designated dates. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the race organizers or any other persons providing any race or Award related services. Award recipients are also responsible for obtaining travel insurance (and all other forms of insurance) at their option, and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance to or for any Award recipient. Lost, stolen, or damaged race materials are not the responsibility of obligation of Sponsor.
By accepting an Award, Participant hereby grants to Sponsor and its designees the right to use Participant’s name, likeness, and other rights personal to Participant, and Participant’s Entry, in connection with the Contest, and for advertising, publicity and promotional purposes for Sponsor throughout the universe in perpetuity in any and all media, including social media now or hereafter known, without Participant’s approval or further notice or compensation to Participant.
7. TAXES: Any valuation of the Award as stated above is based on available information provided to Sponsor. The value of the Award may be taxable to participant as income. The participant is solely responsible for (i) all applicable federal, state, and/or local taxes, and for any fees or costs associated with the award, and (ii) reporting and paying any and all applicable taxes. Participant must provide the Sponsor with valid identification and may be required to provide Sponsor with a valid social security number or tax identification number before the Award is awarded for tax reporting purposes. Participant is solely responsible for all federal, state and local taxes on the Award and any other fees or costs associated with the Award they receive, regardless of whether it, in whole or in part, is used.
8. RELEASE OF LIABILITY:
i. By participating in this Contest, Participant agrees to release and hold harmless Sponsor and its affiliated and subsidiary companies, advertising/promotion agencies, and each of their shareholders, partners, members, directors, officers, employees, franchisees, and agents (collectively, “Released Parties”) (a) from all liability, loss, or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any Award, including any traveling related thereto; (b) against any claim or cause of action, including, but not limited to, personal injury, illness, death, or damage to or loss of property arising out of participation in the Contest or receipt or use or misuse of the Award; and (c) for claims based on publicity rights and intellectual property rights, defamation or invasion of privacy.
ii. The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the Entries; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Contest; (d) technical, electronic or human error which may occur in the administration of the Contest or the processing of entries, including but not limited to inoperable, missing or damaged links; (e) late, lost, undeliverable, incomplete, damaged, illegible, mutilated, destroyed, invalid, unintelligible, misdirected or stolen Entries/mail; (f) for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmission or network connections that are human or technical in nature; (g) any changes of email address, mailing address, and/or telephone number of Participants; (h) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Contest or receipt or use or misuse of any Award; and (i) any lost or stolen Award.
iii. If for any reason a Participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant ’s sole remedy is another entry in the Contest, if it is possible. No more than the stated number of Awards will be awarded.
iv. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of Awards as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Awards by judging all legitimate, un-awarded, eligible Award claims.
v. Sponsor may and reserves the right, in its sole discretion, to: (i) void any suspect Entries; (ii) disqualify an Entry for any or no reason; (iii) disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner; (iv) waive the Contest entry requirements set forth herein; (v) during or upon completion of the Contest Period, request that any Participant resubmit their Entry which fails to comply with the Contest entry requirements prior to any judging period; (vi) cancel, modify, suspend, or terminate the Contest if, for any reason, the Contest, or any part of it, is not capable of being implemented as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest; and (vii) in the event of cancellation, award the applicable Award(s) in accordance with the winner selection criteria set forth above from among all eligible, non-suspect Entries received prior to cancellation, as deemed fair. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right to disqualify entries made in such fashion.
vi. In the event of dispute as to who submitted an Entry, the Entry will be deemed submitted by the Authorized Account Holder of the e-mail used to submit the Entry. “Authorized Account Holder” is defined as the natural person assigned to an e-mail account by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail accounts for the domain associated with the e-mail account in questions. Additional restrictions apply.
vii. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CONTEST INCLUDING THE AWARDS, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
9. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois without giving effect to any choice of law or conflict of law rules.
10. DISPUTES:
i. If a dispute arises between the Sponsor or any Participant, whether or not they are an Award recipient, regarding the Contest, the parties will attempt to resolve such dispute in good faith by direct negotiation by representatives of Sponsor and the Participant. If such negotiation does not resolve the matter within twenty-eight (28) days after notice of the dispute is given, the matter will be resolved by the following alternative dispute resolution (“ADR”) procedure.
To begin an ADR proceeding, a party shall provide written notice to the other party of the issues to be resolved by ADR. Within fourteen (14) days after its receipt of notice of ADR, the other party may, by written notice, add additional issues to be resolved. Within twenty-one (21) days following receipt of the original ADR notice, the parties shall select a mutually acceptable independent, impartial and conflicts-free neutral to preside over the proceeding. If the parties are unable to agree on a mutually acceptable neutral within such period, each party will select one independent, impartial and conflicts-free neutral and those two neutrals will select a third independent, impartial and conflicts-free neutral within ten (10) days thereafter. None of the neutrals selected may be current or former employees, officers or directors of Sponsor or its affiliated or subsidiary companies, or Family, friends, or acquaintances of Participant. The parties shall convene in a location mutually agreed upon to conduct a hearing before the neutral(s) no later than fifty-six (56) days after selection of the neutral(s) (unless otherwise agreed upon by the parties).
The ADR process shall include a pre-hearing exchange of exhibits and summary of witness testimony upon which each party is relying, proposed rulings and remedies on each issue, and a brief in support of each party’s proposed rulings and remedies not to exceed twenty (20) pages. The pre-hearing exchange must be completed no later than ten (10) days prior to the hearing date. Any disputes relating to the pre-hearing exchange shall be resolved by the neutral(s). No discovery shall be permitted by any means, including depositions, interrogatories, requests for admissions, or production of documents.
The hearing shall be conducted on two (2) consecutive days, with each party entitled to five (5) hours of hearing time to present its case, including cross-examination. The neutral(s) shall adopt in its entirety the proposed ruling and remedy of one of the parties on each disputed issue but may adopt one party’s proposed rulings and remedies on some issues and the other party’s proposed rulings and remedies on other issues. The neutral(s) shall rule within fourteen (14) days of the hearing, shall not issue any written opinion, and shall not refer any portion of the dispute to mediation without the parties prior, written consent. The rulings of the neutral(s) shall be binding and non-appealable and may be entered as a final judgment in any court having jurisdiction.
The neutral(s) shall be paid a reasonable fee plus expenses. These fees and expenses, along with the reasonable legal fees and expenses of the prevailing party (including all expert witness fees and expenses), the fees and expenses of a court reporter, and any expenses for a hearing room, shall be paid as follows: (a) if the neutral(s) rule(s) in favor of one party on all disputed issues in the ADR, the losing party shall pay 100% of such fees and expenses; and (b) if the neutral(s) rule(s) in favor of one party on some issues and the other party on other issues, the neutral(s) shall issue with the rulings a written determination as to how such fees and expenses shall be allocated between the parties. The neutral(s) shall allocate fees and expenses in a way that bears a reasonable relationship to the outcome of the ADR, with the party prevailing on more issues, or on issues of greater value or gravity, recovering a relatively larger share of its legal fees and expenses.
ii. THE ARBITRATION OF DISPUTES PURSUANT TO THIS SECTION SHALL BE IN THE PARTICIPANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS CONTEST IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
iii. BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY AWARD, WILL BE RESOLVED INDIVIDUALLY WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN (I) ANY RECOVERY FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR (II) ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) PARTICIPANT 'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY PARTICIPANT.
11. PRIVACY: Sponsor will be collecting personal data about Participant online, in accordance with its privacy policy. Please review Sponsor’s privacy policy (found at /privacy-policy). If you are selected as a winner, your information may also be included in a publicly available winner’s list.
12. PARTICIPANT LIST: To obtain a winner list which is available 60 days after the winning Participants of the of the Contest have been announced, mail a self-addressed stamped envelope to: 775 Waukegan Rd Ste 201, Deerfield, IL 60015, ATTN: TEAM ABBOTT BIB CONTEST WINNER’S LIST. Winning Participant list requests must be received within 60 days of the conclusion of the Contest or after winning Participants have been announced.
